WIPO OFFERS SECURE TOKEN SYSTEM TO AID AS PROOF IN INTELLECTUAL PROPERTY DISPUTES

The World Intellectual Property Organisation (WIPO) has introduced a digital service, WIPO PROOF, which provides a reliable way to record the existence of a digital file (i.e. of an intellectual property asset) at any given moment in time.


With WIPO PROOF, one can obtain a date and time-stamped digital fingerprint of the said digital file, simply by selecting a digital file to be processed. Any digital file, of any size, whether it is numeric, image, executable, text or audio-visual can be processed. After a digital file has been selected, the WIPO PROOF service would create a WIPO PROOF token, which is a date and time-stamped digital fingerprint of the digital file. It is noteworthy that the contents of the selected file are kept confidential, since the file is not uploaded and WIPO PROOF does not read or store the file.


In the event that litigation arises in respect of an intellectual property asset, a WIPO PROOF token may, subject to local laws, be of value in said litigation. In the context of patents, in particular, we see potential usefulness of WIPO PROOF in proceedings such as the right to be named as an inventor and the right to continue prior use.


While WIPO PROOF does not replace the Intellectual Property registration system, eligible parties may consider employing WIPO PROOF as an additional tool to an IP management strategy.
